GENERAL TERMS AND CONDITIONS (ARB) OF IPT ISLAND PROTRAVEL GMBH

At this point, we would like to inform you about our General Terms and Conditions, which supplement the legal provisions of §§ 651a-y BGB and, if validly agreed, form part of the package travel contract concluded between you and us. Please take your time and read the conditions carefully. If you have any questions, please do not hesitate to contact us.

-1- SCOPE OF APPLICATION

These General Travel Terms and Conditions apply to all travel contracts between IPT Island ProTravel GmbH (“IPT”) and the traveller (m/f/d) (hereinafter also referred to as “Customer”) in which IPT combines at least two different travel services for the same trip. They do not apply to the booking of a single tourist service or the arrangement of such a service. When booking a package travel, Customer will be provided with the information required by law, including, but not limited to, the standard form for informing the traveller about package travels, prior to the conclusion of the contract

-2- CONCLUSION OF THE TRAVEL CONTRACT

2.1 By submitting their booking request, Customer makes a binding offer to IPT to conclude a travel contract on the basis of the travel description for the trip in question and these General Travel Terms and Conditions. The booking request is made by the person making the booking on behalf of all participants listed in the booking form; the person making the booking is liable for the fulfilment of the contractual obligations of these participants in the same way as for the person’s own obligations, provided that the person has assumed such liability by express, separate declaration. The booking request may be made in writing, electronically, verbally or by telephone. 

2.2 The travel contract is concluded upon IPT’s acceptance of Customer’s booking request. IPT confirms the conclusion of the contract by sending Customer a travel confirmation / invoice on a durable medium (e. g. by email / as an email attachment), either directly or via the travel agent, and also provides Customer with the security certificate (Sicherungsschein). Only in the case provided for in Article 250 Section 6 (1), second sentence, of the Introductory Act to the German Civil Code (Einführungsgesetz zum Bürgerlichen Gesetzbuch – "EGBGB") (e. g. at trade fairs) will Customer receive the travel confirmation as a hardcopy. 

2.3 Travel agents (e. g. travel agencies, online portals) and service providers (e. g. hotels, transport companies) are not authorised by IPT to enter into agreements, provide information or make assurances that alter the agreed content of the travel contract, go beyond the services promised by IPT under the contract or contradict the travel description.  

2.4 Customer is obliged to check the travel documents received without undue delay (unverzüglich) to ensure they have been issued correctly (name, travel dates, destination, etc.) and to notify IPT of any incorrect details without undue delay (unverzüglich). In particular, misspelt names may result in refusal of carriage by an airline or shipping company, or lead to problems when entering a country. 

2.5 The minimum age for Customers travelling alone is (fully completed) 18 years. Guests aged 17 years (completed or under) must be accompanied by an adult aged 18 or over who is booked into the same room or cabin and who is either the legal representative and guardian, or who holds the original of a valid and signed power of attorney from the legal representative / guardian. 

2.6 For safety reasons, pregnant passengers are unfortunately not permitted to take part in a cruise or in excursions involving a higher degree of risk (e. g. snowmobile safaris) if, at the start of or during the trip, they are in the first to 13th week of pregnancy or at the start of the 22nd week of pregnancy or later. Passengers who are in their 14th to 21st week of pregnancy for the entire duration of the cruise and who have an appropriate confirmation from their doctor stating that they are permitted to take part in the trip and are fit to travel may take part in the trip, but are expressly advised of the limited medical facilities available on board. 

2.7 IPT hereby points out that, pursuant to Section 312g (2) no. 9 of the German Civil Code (Bürgerliches Gesetzbuch – "BGB"), there is no right of withdrawal for package travels offered via distance selling (website); instead, only the statutory rights of rescission and termination apply. This means that Customer cannot revoke their declaration of intent once given; it is binding. Cancellation of the travel contract before the start of the travel is always possible (see clause 6). A right of withdrawal exists only if the contract for travel services under Section 651a BGB was concluded outside business premises (off-premises contract) following oral negotiations (not in the case of online booking), unless the oral negotiations on which the conclusion of the contract is based were conducted at the consumer’s prior request. 

-3- SERVICES PROVIDED BY IPT

The scope of the contractually agreed services and the travel services owed by IPT is set out in the performance description for the relevant trip in the applicable IPT travel description and in the details referring to this in the individual travel confirmation / invoice sent to Customer. 

-4- PAYMENT

4.1 Upon receipt of the travel confirmation / invoice and the security certificate (Sicherungsschein), a partial payment of 25 % of the travel price is due and payable immediately. The partial payment will be credited against the total travel price. The balance of the travel price is due for payment no later than 28 days before the start of the travel, provided that the security certificate (Sicherungsschein) has already been handed over to Customer and it is certain that the travel will take place, in particular (without limitation) that it can no longer be cancelled for the reason specified in clause 10.1. For late bookings made within 30 days before the start of the travel, the total travel price is due immediately and must be paid upon receipt of the security certificate (Sicherungsschein). 

4.2 The date on which the payment is credited to IPT’s account will be decisive for determining whether Customer has paid on time. If payments due towards the travel price are not received despite a reminder and the setting of a reasonable deadline for payment, IPT is entitled to withdraw from the contract and cancel the booking. In this case, IPT may claim damages from Customer, the amount of which is based on the cancellation compensation set out in clauses 6.2 and 6.3, provided that Customer did not themselves have a right to refuse payment. 

4.3 Cancellation compensation in the event of cancellation by Customer (see clauses 6.2 / 6.3) or rebooking fees (see clause 7.1) are payable immediately upon invoicing. The premiums for travel insurance policies arranged by IPT are payable immediately together with the initial partial payment. 

4.4 If Customer chooses to pay by credit card, they authorise the debiting of their credit card account when booking the travel. If IPT has expressly accepted this method of payment in the travel confirmation, Customer’s payment will be deemed to have been made provisionally until it is established that the amount debited by IPT from Customer’s credit card account has not been charged back in full or in part, and that no claim for a refund is being asserted in any other way. If a chargeback occurs for reasons imputable (zu vertreten haben) to Customer, and if a payment obligation is not honoured on time, Customer will be in default and IPT is entitled to charge Customer for any damage incurred as damages for default. The partial and balance payments towards the travel price will be debited in accordance with their due dates also in the case of credit card payment, provided that the security certificate (Sicherungsschein) has been handed over to Customer. 

-5- CHANGES TO THE PRICE AND THE CONTRACT AFTER CONTRACT CONCLUSION

5.1 IPT reserves the right to unilaterally increase the travel price after the contract has been concluded if the increase in the travel price results directly from a) an increase in the price of passenger transport due to higher costs for fuel or other energy sources, b) an increase in taxes and other charges for agreed travel services, such as tourist taxes, port or airport charges, or c) a change in the exchange rates applicable to the package travel in question, which, in each case, actually occurred only after the contract was concluded and could not be foreseen at the time the contract was concluded. In these cases, the travel price will be adjusted to the extent that the increase in the factors referred to under a) to c) affects the travel price per person. Should this be the case, IPT will immediately inform Customer, in a clear and comprehensible manner and on a durable medium (e. g. by email), of the price increase and the reasons for it, and will provide details of the calculation of the price increase. A price increase is only valid if it complies with the requirements set out herein and Customer is informed of the increase no later than 20 days before the start of the travel. Customer may demand a reduction of the travel price if and to the extent that the prices, charges or exchange rates referred to in this clause 5.1 under a) to c) have changed after the conclusion of the contract and before the start of the travel, and this results in lower costs for IPT.  

5.2 IPT reserves the right to unilaterally change contract terms other than the travel price after the contract has been concluded, provided that the changes are insignificant. This may be the case, for example, with changes to transfer and flight times – such as those made by airlines or coach operators – of up to four hours, due to strikes by transport operators, or necessary and reasonable changes to the route of the means of transport (ship, car / coach or aeroplane), including (without limitation) for safety, weather or navigational reasons, to a reasonable extent. This also applies to the skipping of individual ports or a necessary alteration of the timing and sequence of programme items, routes or sections of routes due to weather, wind or other atmospheric conditions, or in the event of transport service cancellations. Likewise, IPT reserves the right to provide suitable alternative hotels in place of those booked. IPT must inform Customer of the change in a clear, comprehensible and prominent manner on a durable medium (e. g. by email or text message). The change is only valid if it meets these requirements and is communicated before the start of the travel. 

5.3 If the price increase reserved for in clause 5.1 exceeds 8 % of the travel price, IPT may not implement it unilaterally. IPT may, however, offer Customer a corresponding price increase and require that they, within a reasonable period specified by IPT, (1) accept the offer regarding the price increase or (2) declare their withdrawal from the contract. The offer regarding a price increase must be made no later than 20 days before the start of the travel. If, due to circumstances arising after the conclusion of the contract, IPT can only provide the travel by altering significantly any of the main characteristics of the travel services (Article 250 Section 3 no. 1 EGBGB) or only by deviating from the special requirements of Customer that have become part of the contract, IPT may offer Customer an appropriate change to the contract and require that they, within a reasonable period specified by IPT, (1) accept the offer to change the contract or (2) declare their withdrawal from the contract. Such an offer to change the contract may not be submitted after the start of the travel. Once the applicable period has expired, the offer regarding the price increase or other change to the contract will be deemed to have been accepted. 

5.4 In its offer regarding the price increase or other change to the contract pursuant to clause 5.3, IPT may also offer Customer the choice of participating in another package travel (substitute package), in which case IPT is obliged to inform Customer in accordance with Article 250 Section 10 EGBGB.

-6- CANCELLATION BY CUSTOMER BEFORE THE START OF THE TRAVEL; CANCELATION COMPENSATION

6.1 Customer may cancel the travel at any time prior to the start of the travel. The date on which the notice of cancellation is received (Zugang) by IPT or the travel agency through which Customer made the booking is decisive. Customer is advised to give notice of cancellation in writing or in text form (Textform) (e. g. by email). 

6.2 If Customer cancels the travel contract, IPT may claim reasonable compensation from Customer. To this end, IPT has set the following flat-rate compensation amounts, which are determined as a percentage of the travel price depending on the time of Customer’s cancellation, based on the period between the notice of cancellation and the start of the travel, the expected savings in costs for IPT, and the expected gains from an alternative deployment of the travel services, as follows: 

  • up to the 30th day before the start of the travel 25 % of the travel price 

  • from the 29th to the 14th day before the start of the travel   50 % of the travel price 

  • from the 13th to the 7th day before the start of the travel 60% of the travel price 

  • from the 6th to the 1st day before the start of the travel 90% of the travel price 

  • on the day when the travel starts / if the trip is not taken 95% of the travel price.  

In any event, Customer is free to prove to IPT that no loss was incurred at all, or that the loss incurred was significantly lower than the flat-rate amounts claimed by IPT.  

6.3 IPT reserves the right to calculate the compensation on a case-by-case basis instead of applying the flat-rate amounts set out above. The amount of compensation is determined on the basis of the travel price, less the value of the expenses saved by IPT and less any gains IPT receives from an alternative deployment of the travel services (Section 651h (2), second sentence, of the BGB). IPT will, at the traveller’s request, provide a justification for the amount of compensation. 

6.4 If Customer cancels their booking due to an offer from IPT regarding a price increase of more than 8 % of the travel price or due to any of the significant changes to the contract specified in clause 5.3, Customer’s cancellation will be free of charge. The tour operator’s claim to compensation also does not apply in the case referred to in Section 651h (3), first sentence, of the BGB. 

-7- REBOOKINGS, SUBSTITUTES

7.1 Customer has no legal right to request changes regarding the travel dates, destination, accommodation, type of catering, mode of transport or vessel (rebooking). If, at Customer’s request, rebookings are nevertheless made after the travel has been booked, IPT will charge a rebooking fee of € 100 per rebooking process implemented in the period until 90 days before the start of the travel. Customer is free to prove that IPT did not incur any loss at all, or that the loss incurred did not amount to this sum. Requests for rebooking received after the 90th day before the start of the travel may, provided they can be implemented at all, only be processed following cancellation of the travel contract in accordance with the conditions set out in clauses 6.2 / 6.3 above, subject to a new booking being made at the same time. 

7.2 Customer may, within a reasonable period before the start of the travel, declare on a durable medium (e. g. by email) that a third party is to assume the rights and obligations under the travel contract in their place. The declaration will in any event be deemed to have been made in good time if it is received (Zugang) by IPT no later than seven days before the start of the travel. IPT may object to the third party’s subrogation if that third party does not meet the contractual travel requirements. If a third party assumes the contract, such third party and Customer will be jointly and severally liable to IPT for the travel price and any additional costs arising from the third party’s assumption of the contract. IPT may only claim reimbursement of additional costs if and to the extent that these are reasonable and have actually been incurred by IPT. IPT must provide Customer with evidence of the amount of additional costs incurred as a result of the third party’s assumption of the contract. 

-8- TRAVEL INSURANCE

To cover the costs of cancellation and curtailment of the travel, IPT strongly recommends taking out travel cancellation insurance and can arrange for Customer to take out travel cancellation insurance or insurance to cover the costs of support and assistance, including repatriation in the event of an accident, illness or death. Customers are also advised to take out international travel health insurance providing comprehensive cover abroad, including repatriation from abroad, which is valid for the entire duration and for all destination countries of the travel. 

-9- UNUSED SERVICES

If Customer does not make use of individual travel services which IPT has duly offered them, for reasons imputable (zu vertreten haben) to Customer alone (e. g. due to early return, illness, unfitness to travel), Customer will not be entitled to a pro rata refund of the travel price.  

-10- CANCELLATION AND TERMINATION BY IPT

10.1 IPT may cancel the contract and the travel until 28 days before the start of the travel if the minimum number of participants is not reached, provided that IPT has specified in the relevant pre-contractual information (e. g. the travel description) the number of participants required and the deadline by which the traveller must have received (Zugang) the notice of cancellation at the latest prior to the contractually agreed start of the travel, and has also specified the minimum number of participants and the latest cancellation deadline in the travel confirmation. 

10.2 IPT may also cancel the contract before the start of the travel if IPT is prevented from performing the contract because of unavoidable and extraordinary circumstances.  

10.3 If IPT cancels the travel contract in accordance with clause 10.1 or 10.2, IPT’s claim to the agreed travel price will lapse. Any payments already made towards the travel price will be refunded to Customer. 

-11- CUSTOMER`S OBLIGATIONS, REMEDIAL ACTION, SETTING A DEADLINE PRIOR TO TERMINATION BY CUSTOMER`S, REPORTING DAMAGE TO, DELAY IN DELIVERY OR LOSS OF LUGGAGE

11.1 Customer must report any lack of conformity of the travel to the local tour guide / IPT’s local service provider as well as to the address / telephone number given below without undue delay (unverzüglich), and request that the matter be remedied within a reasonable period. The contact number is always included in the booking confirmation. If IPT has been unable to remedy the situation due to a culpable (intentional or negligent) failure to report the issue, Customer will not be entitled to assert the rights under Section 651m BGB or to claim damages under Section 651n BGB. If Customer demands remedy, then IPT must remedy the lack of conformity of the travel. IPT may refuse such remedy if it is impossible or, taking into account the degree to which the travel lacks conformity and the value of the travel service concerned, would entail disproportionate costs. IPT may remedy the situation by providing substitute performance of equal or higher value. If IPT is entitled to refuse to remedy the lack of conformity and such lack of conformity affects a significant part of the travel services, IPT must offer remedy by appropriate substitute performance. 

11.2 If a travel is significantly impaired as a result of the lack of conformity and IPT fails to remedy the situation within a reasonable period, Customer may terminate the travel contract in accordance with the statutory provisions; for reasons of proof, a written or electronic notice of termination is recommended. Customer is only exempt from their obligation to set a deadline for remedy if IPT refuses to remedy the situation or if immediate remedy is necessary. If Customer terminates the contract, IPT retains the right to the agreed travel price in respect of the travel services already provided and those still to be provided to terminate the package travel; Customer’s claims under Section 651i (3) nos. 6 and 7 BGB remain unaffected. 

11.3 Damage to luggage, delays in delivery of luggage or loss of luggage in connection with flights must be reported without undue delay (unverzüglich) and on the spot to the relevant airline in accordance with the requirements under international conventions; loss of luggage must be reported within 7 days and a delay in delivery of luggage within 21 days following the handover of the luggage, and it is recommended that the claim be subsequently asserted in writing as well. 

11.4 Customer is solely responsible for making sure that they arrive at the point of departure in good time for the start of the package travel, particularly when travelling independently to the point of departure on flights they have booked themselves. When booking parts of a travel or flights independently, it is recommended that Customer allows for plenty of buffer time and, for example when using Rail & Fly tickets, arrives at the airport at least three hours before departure in order to comfortably complete check-in and pass through security and/or health checks. Likewise, when booking connecting flights independently, Customer should allow for a generous time buffer and, where possible, choose a fare that allows for rebooking at any time free of charge or at low cost. 

-12- cUSTOMER`S DUY TO COOPERATE, DUTY TO CHECK THEIR PHYSICAL FITNESS FOR TRAVEL, AND DUTY TO MITIGATE DAMAGE

12.1 Customer is obliged, prior to the travel and, where necessary, by consulting a medical professional, to carefully assess for themselves whether participation in the travel, with its specific features and route, is actually compatible with their physical condition, constitution and current state of health. In doing so, Customer must take into account that the booked travel may be one where medical assistance is not always available. In the case of serious health issues, Customer is obliged to provide a medical certificate confirming their fitness to travel. 

12.2 If performance by IPT is impossible within the meaning of Section 275 BGB because the traveller is unfit to travel due to illness or for any other reason (e. g. arrival at the point of departure without a mandatory accompanying person), Customer’s claim to performance is excluded. In such cases, the traveller hereby agrees to be examined by a doctor / on-board doctor, who will assess their fitness to travel and, if necessary, establish their unfitness to travel, which finding will be binding on both parties. 

12.3 Customer must take all reasonable steps to prevent damage from occurring and to minimise any damage that has occurred. In particular, Customer must draw IPT’s attention to any risk of damage. 

 

-13- IPT`S LIABILITY AND LIMITATION OF LIABILITY

13.1 IPT’s contractual liability for damage other than personal injury and not caused by fault (intentional or negligent conduct) is limited to three times the price of the travel. This limitation of liability does not apply to claims arising under the Montreal Convention. 

13.2  For cruises, the following applies: International carriage of passengers by sea is governed by the Athens Convention, which came into force on 23 April 2014, and by Regulation (EC) No 392/2009. The carrier’s liability for any claims for damages arising from shipping incidents in the case of the death of, or personal injury to, a passenger, or in the case of loss of or damage to luggage as well as deductibles (amounts to be deducted in the case of loss or damage) will in no case exceed the limits set out in the Athens Convention in its respective version valid at the time and the associated protocols (see currently the provisions in Articles 3, 5, 7 and 8 of the Athens Convention). The deductible permitted under Article 8 (4) of the Athens Convention applies. Contributory fault on the part of the passenger will always be taken into account (Article 6 of the Athens Convention). The carrier is not liable for incidents occurring before the passenger has boarded the ship or after they have disembarked. The same applies to hand luggage in the passenger’s custody. The carrier accepts no liability for live animals carried as luggage. The carrier is not liable for damage occurring during transport on ships executed by another carrier. The carrier is not liable for the loss of or damage to monies, negotiable securities or other objects of value such as gold, silverware, jewellery, ornaments, works of art, electronic equipment or other valuables, except where such valuables have been deposited with the carrier for the agreed purpose of safe-keeping (in which case the carrier’s liability is limited in accordance with Article 8 (3) of the Athens Convention). Customer is solely responsible for making sure that such items are kept safe in their hand luggage. 

13.3 Where Customer is offered internet access whilst travelling, Customer may use this access themselves free of charge, but must not permit unauthorised third parties to use it. IPT does not guarantee the continuous actual availability, suitability or reliability of the internet access for any specific purpose, including, without limitation, for any intended professional or business use, such as use for working from home. IPT accepts no liability for interruptions to internet services, for example due to weather conditions, signal loss, the remoteness of a location or for other reasons causing the loss of the satellite signal. Customer accepts and acknowledges that the internet connection, including the possibility of signal loss, exists, and that the internet connection may be unstable or unavailable. IPT is not liable for any incidents arising therefrom or for any damage suffered by Customer as a result thereof. IPT is also entitled at any time to restrict or suspend Customer’s access to the internet, in whole or in part or temporarily, if the connection is being or has been misused. Data transfers made using the existing data connection are unencrypted. Use of the WLAN is at Customer’s own risk. There is a risk that malware may be transmitted to Customer’s device whilst using the WLAN. IPT accepts no liability for such damage. If Customer visits websites that charge a fee, the resulting costs must be borne by Customer. Customer must use the internet connection in a legally sound manner and must not use it to access or disseminate content that is immoral or unlawful. Customer is obliged to indemnify IPT against any and all damages or claims of third parties arising from Customer’s unlawful use, including all associated costs incurred by IPT in taking and/or defending against legal action. Where WLAN is available in a hotel or accommodation, this clause 13.3 also applies to Customer’s use of the WLAN there, and IPT does not guarantee the continuous actual availability, suitability or reliability of the internet access in the hotel or accommodation for any specific purpose, including, without limitation, for any intended professional or business use, such as use for working from home. 

-14- OBLIGATIONS TO PROVIDE INFORMATION REGARDING THE IDENTITY OF THE OPERATING AIR CARRIER

Under Regulation (EC) No 2111/05, IPT is obliged to inform Customer upon reservation (i. e. upon booking) of the identity of the operating air carrier with regard to any air carriage services to be provided as part of the booked travel. Where the identity of the operating air carrier or carriers is not yet known at that time, the tour operator must name the air carrier or carriers that is or are likely to act as operating air carrier or carriers and must ensure without undue delay (unverzüglich) that Customer is informed of such identity without undue delay (unverzüglich) as soon as it is established. The same applies if the operating air carrier changes. The list published by the European Union of airlines that are subject to an operating ban within the European Union can be found on the website www.transport.ec.europa.eu/transport-themes/eu-air-safety-list_en.

-15- PASSPORT AND VISA REQUIREMENTS, PUBLIC HEALTH REGULATIONS

IPT informs Customer of the passport and visa requirements of the country of destination, including the approximate timeframes for obtaining visas, as well as of public health formalities (e. g. vaccinations and medical certificates required by the authorities) that must be fulfilled for the travel and the stay. Customer is responsible for obtaining and carrying the necessary travel documents and must ensure on their own that their passport or identity card has sufficient validity for the travel.  

-16- DATA PROTECTION; RIGHTS TO OBJECTS

16.1 IPT informs Customer about the processing of their personal data in the privacy policy on the website and in the data protection information. IPT complies with the provisions of the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG) and the GDPR when processing personal data. Personal data are pieces of information relating to the personal aspects of a specific individual (e. g. name, address, email address). These data are processed to the extent necessary for the proper handling of Customer’s enquiry or booking request, in order to take steps prior to entering into a contract, or for the performance of the travel contract. Pursuant to Article 6 (1), first sentence, point (b) of the GDPR, data processing is permitted for the aforesaid purposes. The data will not be disclosed to unauthorised third parties without Customer’s express consent. Customer has the right at any time to access their stored personal data, to request information about these data, to have them altered, rectified or erased, to have their processing restricted, to object to their processing, to have them transmitted, and to lodge a complaint with a supervisory authority regarding their processing (all rights under Articles 15 to 20 of the GDPR). The data will be deleted when they are no longer required for the performance of the contract or when their storage is unlawful. Where Customer’s personal data are processed on the basis of legitimate interests pursuant to Article 6 (1), first sentence, point (f) of the GDPR, Customer has the right, pursuant to Article 21 of the GDPR, to object, on grounds relating to his or her particular situation, to processing of personal data concerning him or her. Customer may exercise their right to object by sending an email to memo@islandprotravel.de or by contacting IPT at the address given below. 

16.2 By sending an email to memo@islandprotravel.de, Customer may also object, free of charge and at any time, to the use or processing of their data for the purposes of advertising, market or opinion research, or for marketing purposes. 

 

-17- MISCELLANEOUS, INFORMATION ON ONLINE DISPUTE RESOLUTION AND CONSUMER ARBITRATION

Certificate of Insolvency Protection for Package Tours Nr: 100152-2026
pursuant to Section 651r of the German Civil Code (Bürgerliches Gesetzbuch - BGB)

This certificate of insolvency protection applies to the booking party and all travel participants. It is valid for all package tours booked between January 1, 2026 and December 31, 2026, and remains effective until the completion of the trip.

In the event of the insolvency of
